Merchants Petition Supreme Court in Debit Interchange Case (Aug. 20, 2014)
A group of merchant associations this week petitioned the U.S. Supreme Court to review a March decision by the U.S. Court of Appeals for the District of Columbia. That decision reversed a lower court’s ruling in NACS, et al v. Board of Governors of The Federal Reserve System that the Fed set too high a limit on debit card interchange fees in 2011. The merchant groups were given two extensions by the appellate court, giving the plaintiffs additional time to evaluate their case and decide to appeal. Filing the petition on Monday were the National Retail Federation, the National Association of Convenience Stores (NACS), the Food Marketing Institute, the National Restaurant Association, Boscov’s Department Store and Miller Oil Co., all of which were plaintiffs in the original lawsuit.
