Judge Rules that Radio Shack Gift Card Holder Won’t Get Legal Fees Paid
A Radio Shack gift card holder’s motion to get his legal fees and expenses paid first in the electronics retailer’s Chapter 11 case has been denied. In a March 17 opinion, U.S. Bankruptcy Judge Brendan L. Shannon said the plaintiff, Mark Haywood, didn’t have as much impact on a $46 million settlement of multistate gift card claims Radio Shack as he had claimed. Judge Shannon cited the efforts of several state attorneys general, including Texas, New Hampshire, New York, Oregon, Pennsylvania and Tennessee, as taking the lead on initial negotiations to ensure gift card holders received priority in the case. The judge also said that Haywood presented no evidence that he had acted other than in his own interest.
Consumers with Radio Shack gift cards may file a claim by Dec. 2, 2016, for priority consideration at https://cases.primeclerk.com/radioshack/GiftCard-Home. If the court-established trust determines the claim to be valid, claimants will receive 100 percent of the card balance, according to the Website.
